Reporting from Denver - During regular emergency drills at Deer Creek Middle School in suburban Denver, math teacher David Benke always told himself and his students that, should something dire occur, he would try to protect them.

So when he spotted a rifleman shooting at students who were leaving school Tuesday, Benke didn't hesitate. "I made a promise," he said.

The 57-year-old teacher charged the gunman and knocked him to the ground. While an assistant principal grabbed the rifle, Benke and another teacher kept the shooter pinned until police arrived.

The FBI and a Philadelphia-area prosecutor are looking into whether a school district broke the law when it remotely activated cameras on school-owned laptops and watched students in their homes.

The parents of 15-year-old Blake Robbins have filed a lawsuit against Harriton High School of the Lower Merion School District, alleging their son's privacy was violated.

The teenager said he found out about the remote surveillance when he was confronted by his assistant principal at the Rosemont school.

A Pennsylvania family is suing the Lower Merion School District, accusing an assistant principal at Harriton High School of watching their son through his laptop's webcam while he was at home and unaware he was being watched. The family also says the school official used a photo taken on a laptop as the basis for disciplining the student.

In a civil complaint (PDF) filed in federal court, a student at the school, Blake Robbins, said he received a notice from an assistant principal informing him that "the school district was of the belief that minor plaintiff was engaged in improper behavior in his home, and cited as evidence a photograph from the Webcam."

The district said in a statement that the "security feature was installed to help locate a laptop in the event it was reported lost, missing or stolen so that the laptop could be returned to the student." The district further explained that "upon a report of a suspected lost.

As swine flu fears mount, 30 of the Flushing school's 50 teachers were absent Wednesday - and nearly a third of its 747 students didn't show.

The grieving widow of beloved educator Mitchell Wiener vowed Monday night to return to the classroom within days at an emotional vigil for the city's first swine flu victim.

Bonnie Wiener, who teaches at Intermediate School 238 in Hollis, Queens, where her husband was an assistant principal, told mourners she will be back at work early next week.

"They can't keep me away," Bonnie Wiener said.

Looking sad and weary, Bonnie Wiener stood at the entrance of her school, welcoming many of the 200 mourners with embraces.

Mitchell Wiener, 55, who died Sunday, was listed in critical condition when he was admitted to the hospital.

But Dr. Thomas Frieden would not discuss the nature of the condition.

Mitchell Wiener, assistant principal of Intermediate School 238 in Queens, died Sunday evening of complications of the H1N1 virus, commonly known as swine flu, hospital and state officials said.

A Flushing Hospital spokesman earlier had declined to say whether Wiener had any pre-existing medical conditions.
